Andalusia has 53,282 hectares of coastal-marine protected area. In other words, of which measures 979.5 kilometers off its coast, is protected, at least on the map, 286.2 km, ie almost 30% of its coastline. This region pioneered twenty years ago to enact a law adopted by the inventory of protected natural areas of Andalusia and set out measures for their protection (Law 2 / 1989, Inventory of Natural Areas Protected Andalusia).

On November 27, 2008, the Andalusian Parliament approved the new Law 1 / 2008, tax and financial measures and promoting economic activity. Under cellophane to combat the economic crisis, the Andalusian Government changed laws to ten, seven of which relate to the environment. The new text approved, inter alia, an amendment to the Law on Spatial Planning of Andalusia (LOUA) to enable the Board to declare a “autonomous” action it deems appropriate, which requires sub-plans to adapt.

URBAN GROWTH
According to the Ministry of the Environment, between 1956 and 2003 the Andalusian cities increased its five built, an increase occurred at the expense of eliminating agricultural land (by 76.40%) and forest (23.17%). This has been disproportionate growth well above population growth. This fact is reflected in so-called medium-sized cities between 50.000-100.000 inhabitants, who have increased their population by half a 115.9% since 1956 but, however, have a 593.6% increase in floor area.

Among the problems that uncontrolled development, the Board refers to the purification of water, energy consumption, waste management or ownership called urban spaces adjacent to the city (urban area expansion that causes, among other things, the dependence of the car and the consumption of soil).

Marina of ANDALUSIA
In this region boat registrations have fallen by 10% over the previous year, in Andalusia (which has a current list of 15,654 berths, 18.3% in Spain), the network of marinas will increase its supply of berths 11%. The crisis begins to be felt in the field of recreational boating, but the Board continues to believe that this segment of tourism quality and to give an impetus to the challenge of Andalusia with 25,000 berths by 2015. To do this has already begun the expansion of four ports and the construction of another more than 2,000 new seats will the pontoons.

According to the Public Agency Port Andalusia (APPA), these first results are visible in the ports of Punta Umbria (Huelva) and Garrucha (Almería), which are already running to house the works in his sheet of water up to 70 and 350 boats, respectively. They will join 600 outstanding opening berth in the port of San Andrés (Malaga) and 200 more in the port of El Terrón Lepe (Huelva). Greenpeace presentó el pasado 7 de julio la novena edición del informe Destrucción a Toda Costa. Analizado el estado de 233 espacios litorales protegidos, repartidos en los más de 8.000 kilómetros de litoral. El informe deja en evidencia que incluso los Espacios Naturales Protegidos de la costa están lejos de mantenerse a salvo de la destrucción a la que se está sometiendo al medioambiente ya sea por urbanismo, infraestructuras o contaminación. El informe analiza región por región los problemas que presenta el litoral y denuncia las causas de las agresiones. Finalmente hace una llamado a las distintas autoridades (estatales, regionales y locales) para que respeten y acaten la ley de costas, e incluso la refuercen en algunos puntos, para la mejora y conservación del medioambiente marino.

The Spanish law about the Coast semms to have no effect in many cases! Somebody should miss the 100 meters from the highest level reached by the sea with less 10 meters from the usual level in this area.

In this issue you can find the contents of Auken Report, aproved on 26/03/2009 on European Parliament, in which is demanded to stop any communitary help to Spain, until all the urbanistic irregularities and abuses denounced in Brussels by citizens of several countries of EU will be solved.

The resolution is extremely hard with the urbanistic situation in Spain actually. Has been written by green party deputy Margrete Auken, in which request to be suspended and reviewed all the new plans that don´t respect environmental laws and respect the right to the property. It also demands to freeze and suspend the urbanistic developments that do not follow the communitary laws.

The text remarks

In Spain there is an endemic form of corruption

responsibilizing to all levels of administration of following an unsustainable development model.

Also is detailed that

Judicial authorities are not properly prepared to confront these abuses. Sentences dictated in most of these cases cannot be executed to compensate the victims of the infringements of the law; it also increases the feeling of many affected citizens of the UE, non-Spanish, about the lack of responsability, action and partiality of Spanish judicial sistem

The report states

…worrying about the situation of the urban plannification in Marbella, in Andalucia, where hundreds of thousands of housing have been raised illegaly, that are against the communitary laws…

And the worse of it is that many urbanizations and plots are built on protected areas of the Natura 2000 Net, as the ones that exist in Cabo de Gata (Almería) and several parts of Murcia. Spain is urgently requested to review and modify the Law about the Coast

…in order to protect the rights of the housing owners and those that bought small surfaces of coastal land wich don´t have negative impact over the coastal environment

Pioneer as tourism model in Spain, Benidorm is an extreme example of those methods that do not take care about traditional uses and represent unsustainable models of development. The problems generated by water supply for a population that increases in several thousands in summer, luminic pollution, residual waters dump to the sea... are more than evident problems.

The devastating conclusions in the report by danish deputy Margret Auken was voted at the European Commision by 349 votes Yes, 110 votes No, and 114 in white. It is the third time the plenary denounces urbanistic defaults in Spain in the current legislature. First one happened on december 2005, second on june 2007.
